Automated appointment-confirmation/reminder and proactive service-update SMS campaigns are not currently enabled; review your account for appointment and service status. We do not enroll you in marketing texts. Message frequency varies. Message and data rates may apply. Consent is optional and is not a condition of booking, submitting an inquiry or purchase. Entering a phone number or accepting general terms does not give SMS permission. Reply STOP to opt out of further texts, or HELP for help. A STOP request stays in effect even if a web form is later checked; reply START from that number to resume. A direct inquiry authorizes a response to that inquiry, not unrelated or recurring texts. TERMS OF SERVICE Booking terms version: gifted-pros-booking-terms-2026-10-22 Last Updated: October 22, 2026 AGREEMENT TO TERMS These Terms of Service ("Terms") govern your access to and use of Gifted Pros, a mobile service marketplace platform operated by GIFTED PROS LLC ("Gifted Pros," "we," "us," or "our"). By accessing or using our platform, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access or use our services. ELIGIBILITY To use Gifted Pros, you must: • Be at least 18 years old • Have the legal capacity to enter into binding contracts • Provide accurate and complete registration information • Comply with all applicable laws and regulations • Not be prohibited from using our services under applicable law USER ACCOUNTS Account Creation • You must create an account to access certain features • You are responsible for maintaining the confidentiality of your account credentials • You agree to notify us immediately of any unauthorized access • You are responsible for all activities under your account Account Termination We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to users or the platform. SERVICE PROVIDER REQUIREMENTS To become a service provider on our platform, you must: • Identity Verification: Complete our multi-step identity verification process • Documentation: Provide valid government-issued identification, business licenses, and insurance certificates • Background Checks: Successfully pass background checks conducted through our certified partners • Professional Credentials: Maintain all required licenses and certifications for your services • Insurance: Carry adequate liability insurance as required by law and platform policies • Compliance: Agree to ongoing monitoring and periodic re-verification Provider Responsibility Service providers are independent contractors, not employees of Gifted Pros. Providers are solely responsible for the quality and legality of services provided to customers. PLATFORM USE Permitted Use You may use Gifted Pros to: • Book services from verified providers • Provide services as a verified provider • Communicate with users and providers for service-related purposes • Leave reviews and ratings based on actual service experiences Prohibited Activities You may NOT: • Violate any laws or regulations • Impersonate others or provide false information • Harass, threaten, or abuse other users • Attempt to circumvent security measures • Post fake reviews or manipulate ratings • Use the platform for unauthorized commercial purposes • Scrape or collect user data without permission • Interfere with platform operations • Reverse engineer or copy platform features PAYMENTS AND FEES Prepayment: For a standard fixed-price service, customers pay the service total disclosed for the current booking before that booking is confirmed. Funds are held until the customer approves the completed service; Gifted Pros and the provider receive their respective shares only after approval. Inspection deposits are separate from full prepayment. Where the booking discloses an inspection deposit, the deposit is not the final service price. The final scope and price are provided after inspection and require the customer's explicit approval before work or additional charges. The disclosed deposit is credited toward the final service total. If the customer does not proceed, the disclosed refund and non-refundable portions apply as stated in the inspection deposit disclosure; no additional fee or deadline is implied. Platform Fees: Gifted Pros may charge platform fees or commissions as disclosed during booking. Payment Processing: All payments are processed through secure third-party payment providers. Cancellations: Cancellation and refund policies are subject to individual service provider terms where disclosed. Missing or unclear provider-specific terms should be clarified with Gifted Pros before proceeding. Disputes: Payment disputes should be raised within 30 days of service completion. BOOKING TERMS AND SERVICE DISCLOSURES Current acceptance version: gifted-pros-booking-terms-2026-10-22 A new booking, quote approval, or payment commitment requires explicit acceptance of the current terms version and the displayed service scope and price. Continued use alone does not accept changed material terms for a new booking or payment commitment. Standard booking disclosure: Review the service, scope and price before committing. Payment is required before confirmation; funds remain held until you approve completed work. Existing provider cancellation and refund terms apply where disclosed. Inspection and quote disclosure: Standard Car Detailing and Gifted Cleaners inspection-based services require a $100 deposit. The full $100 is credited toward the service total. If you do not proceed, $50 is refunded to you and $50 is non-refundable. Final scope and price are determined after inspection and require your acceptance before work or additional charges. You may not reproduce, distribute, modify, or create derivative works without our express written permission. DISCLAIMERS AND LIMITATION OF LIABILITY Service "As Is" Gifted Pros is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, secure, or error-free service. Provider Services Gifted Pros is a marketplace platform connecting users with independent service providers. We are not responsible for the quality, safety, or legality of services provided. All service agreements are directly between users and providers. Limitation of Liability To the maximum extent permitted by law, Gifted Pros shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of profits, data, or goodwill. INDEMNIFICATION You agree to indemnify and hold harmless Gifted Pros, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: • Your use of the platform • Your violation of these Terms • Your violation of any third-party rights • Services provided by you as a service provider DISPUTE RESOLUTION Informal Resolution Most disputes can be resolved informally. Please contact us at support@giftedpros.com before pursuing formal action. Arbitration Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class actions. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. CHANGES TO TERMS We reserve the right to modify these Terms at any time. Material changes will be notified through the app or via email. Continued use of Gifted Pros does not by itself accept changed material terms for a new booking or payment commitment; explicit acceptance of the current terms is required for each new commitment.
